Travel Ban Deemed Unconstitutional

The 4th Circuit Court of Appeals ruled the administration’s third iteration is “tainted with animus toward Islam.”

A Virginia federal appeals court ruled earlier today that the latest version of President Trump’s travel ban is unconstitutional, though the Supreme Court has ordered the ban can stay in full effect until it takes up the case this spring.

The Richmond, VA-based 4th Circuit Court of Appeals ruled 9-4 that the Trump administration’s third iteration of the travel ban is “unconstitutionally tainted with animus toward Islam.”

Judges pointed to comments made by President Donald Trump himself as evidence that the administration has crafted the ban based on religious animosity. The third version of the travel ban bars travelers from eight countries – six of which are predominantly Muslim – from entering the U.S.

The court’s ruling follows a similar finding last December by a panel of the 9th Circuit Court of Appeals.

The Supreme Court agreed last month to review the legality of the travel ban and the case is expected to be argued in April.
