States Prepping Challenge to Biden Vaccine Mandate

Numerous Republican-led states are preparing to challenge the legality of the Biden administration’s vaccine mandate for private companies.

Last month, President Joe Biden directed the Labor Department to write rules requiring all businesses with 100 or more employees to vaccinate their workers or have them undergo weekly COVID-19 testing. Biden is also requiring all health facilities that accept Medicare or Medicaid funding to vaccinate their workforces and all federal employees to get vaccinated as well, without the option of regular testing instead.

The rules are close to taking effect, as the Occupational Safety and Health Administration (OSHA) delivered its proposal to the Office of Management and Budget (OMB) for final review last week.

The attorneys general for 24 Republican-led states sent a letter to the White House last month vowing to challenge the vaccine mandate in court as soon as it takes effect.

“Your plan is disastrous and counterproductive,” the attorneys general wrote. “From a policy perspective, this edict is unlikely to win hearts and minds – it will simply drive further skepticism.”
