Disciplining and terminating employees can be a very time consuming and complicated process. Unfortunately, at times, it simply must be done. The process is even more difficult when an employer needs to discipline an employee for conduct that occurs off-duty. Our beliefs and actions have never been more open to scrutiny as we willingly or inadvertently have aspects of our life broadcast through social media. While employers usually discipline employees for actions during the work day, it has become increasingly necessary for some employers to respond to employees’ misconduct even while off duty. This presentation will discuss the legal and practical issues relating to off-duty misconduct and how employers can respond.  There will be a focus on personnel policies, employees’ use of social media, drug and alcohol issues, including medical marijuana, and limits on an employer’s authority.
